At trial in the summer of 2023, sixteen young people asserted their rights. They testified to the economic and health impacts of spring floods, smoke-filled skies, and extreme summer heat while working on the family ranch and recreating outdoors; about maintaining ancient tribal traditions tied to the seasons in the absence of winter snow and heat-ravaged harvests of roots and berries; and about impacts to their cherished landscapes across Montana. Today, in a resounding victory (6:1), the Montana Supreme Court upheld Judge Seeley’s historic ruling. It is a new era in Montana today, rooted in constitutional protection for children instead of protection for an extractive industry whose time must end as we enter a new energy future powered by sun, wind and water.
